ACCEPTANCE OF TERMS By creating an account with TSB Lifestyle LLC, you agree to be bound by these Terms and Conditions. If you do not agree, do not create an account. 2. ELIGIBILITY You must be at least 25 years of age to use this service. You represent that you meet this requirement. 3. ACCOUNT AND MEMBERSHIP Your account requires admin approval before you can access member features. You are responsible for maintaining the confidentiality of your password. All memberships are free. We will treat anyone who uses your password as you. We recommend that you maintain your username and password in confidence and notify us immediately if you suspect unauthorized use. 4. SITE VISITORS VS. MEMBERS Users who access our site without registering as Members ("Site Visitors") have very limited access to the facilities we provide. Site Visitors do not have access to Member profiles, member-only content, or other features reserved for registered Members. Only registered Members who have completed the registration process and received approval may access Member profiles and participate fully in the community. 5. CONDUCT Members must conduct themselves respectfully. You agree not to: (a) upload or transmit content that is false, defamatory, harassing, illegal, obscene, or abusive; (b) infringe any third party's intellectual property or privacy rights; (c) transmit viruses or other harmful code; (d) use the site for unlawful purposes; or (e) obtain access through hacking, scraping, or other unauthorized means. TSB Lifestyle LLC reserves the right to suspend or terminate accounts for violations. 6. PRIVACY Your profile information and photos are subject to our privacy practices. Do not share content you are not comfortable with others seeing. Choose carefully the information you post on your profile. Do not include personally identifying information such as your telephone number, street address, or email address in publicly visible areas. 7. COMPLAINTS AND REPORTS If you believe that another Member or user has acted inappropriately or violated our Code of Conduct, you may report your concerns by contacting us. If we are notified that content or conduct does not comply with these Terms, we may investigate and determine, in our sole discretion, whether to remove or block access to such content, or to take action against the person or persons responsible. We have the right (but not the obligation) to remove, relocate, or otherwise block or restrict any content at any time, with or without notice, to ensure compliance with these Terms. 8. REVOCATION OR SUSPENSION OF USE PRIVILEGES We reserve the right at any time to terminate or suspend your account or your access to our site or certain features if you engage in activities that we conclude, in our sole discretion, breach our Code of Conduct or otherwise violate these Terms. If you have a dispute with one or more Members, you release TSB Lifestyle LLC (and our officers, directors, agents, employees, and affiliates) from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such dispute. 10. WARRANTY DISCLAIMER TSB LIFESTYLE LLC DOES NOT WARRANT THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT THE CONTENT AND FEATURES OFFERED ON OUR SITE WILL BE PROVIDED ERROR-FREE OR UNINTERRUPTED. THE SITE AND ALL PROGRAMS AND FEATURES ARE AVAILABLE ON AN "AS IS" AND "AS AVAILABLE" BASIS. TSB LIFESTYLE LLC DOES NOT WARRANT OR REPRESENT THAT THE SITE OR ANYTHING YOU DOWNLOAD FROM THE SITE WILL BE FREE OF VIRUSES OR OTHER HARMFUL FEATURES. TO THE EXTENT PERMITTED BY APPLICABLE LAW, TSB LIFESTYLE LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. YOU EXPRESSLY AGREE THAT USE OF THE SITE IS AT YOUR SOLE RISK. 11. LIMITATION OF LIABILITY UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO BREACH OF CONTRACT, TORT, OR NEGLIGENCE, WILL TSB LIFESTYLE LLC BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS) THAT ARISE OUT OF, OR ARE RELATED TO, YOUR USE OF THE SITE, ITS PROGRAMS, SERVICES, OR CONTENT, EVEN IF TSB LIFESTYLE LLC IS AWARE OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL TSB LIFESTYLE LLC'S AGGREGATE LIABILITY TO YOU FOR ANY LOSS, DAMAGE, OR CLAIM RELATED TO, OR ARISING OUT OF, THE SITE OR ANY PROGRAMS OR SERVICES YOU RECEIVE FROM THE SITE EXCEED $100.00. YOU MAY ENGAGE IN OFFLINE ACTIVITIES WITH MEMBERS FROM OUR SITE. YOU ACKNOWLEDGE THAT TSB LIFESTYLE LLC MAKES NO WARRANTIES WITH RESPECT TO ANY MEMBER OR ANY INFORMATION PROVIDED BY ANY MEMBER. YOU AGREE TO RELEASE AND HOLD TSB LIFESTYLE LLC HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS, AND ACTIONS OF ANY KIND ARISING FROM YOUR PARTICIPATION IN ANY SUCH OFFLINE ACTIVITIES. 12. INDEMNITY You agree to defend, indemnify, and hold TSB Lifestyle LLC and its subsidiaries, affiliates, officers, directors, agents, and employees harmless from any liability to third parties, including reasonable attorneys' fees, arising from or related to your breach of these Terms. 13. CHANGES TSB Lifestyle LLC may update these terms. Continued use of the service after changes constitutes acceptance. If we modify these Terms, any modifications will take effect upon your subsequent access to the site.
